Judgment
Arindam Lodh, J
This is an application filed by the State-applicant for striking out the name of the respondent no.1 from the cause title of Writ Petition No.(C) 965 of 2022 since the State-applicant is not a necessary party in the connected writ petition.
Heard Mr. D. Sarma, learned Addl. G.A. appearing for the State-applicant. Also heard Ms. A. Debbarma, learned counsel appearing for the respondent nos. 1 & 2 i.e. the original petitioners in the connected writ petition and Mr. N. Majumder, learned counsel appearing for the respondents-TSECL.
Mr. N. Majumder, learned counsel appearing for the respondents-TSECL, submits that the State Finance Department is a necessary party for proper adjudication of the writ petition, which submission is also supported by Ms. A. Debbarma, learned counsel appearing for the original petitioners of the writ petition.
I have given my thoughtful consideration to the submission advanced by learned counsels appearing for the parties. In my opinion, considering all aspects, State Finance Department is necessary party in the connected writ petition.
Accordingly, the application for striking out the name of State from the cause title of the writ petition stands dismissed.
