Learned P.P., Mr. Raju Datta along with Learned Addl. P.P., Mr. Rajib Saha is present on behalf of the State.

This application is filed by the State-applicant under Section 439(2) of Cr.P.C. challenging the order dated 29.01.2024 passed by Learned Special Judge, Sepahijala District, Sonamura in connection with Special(NDPS) No.85 of 2023. By the said order, Learned Special Judge has granted bail to the respondent-accused namely Uttam Datta in connection with Special(NDPS) No.85 of 2023 arising out of Sonamura P.S. No.93/2023 for the offence punishable under Section 20(a)(i)/20(b)(ii)(c)/25/29 of NDPS Act.

Learned P.P. also drawn the attention of the Court that by order dated 20.06.2024 passed in connection with B.A. No.30 of 2024, similar issue was dealt with by this Court.

Let the notice be issued upon the respondent-accused.

Learned P.P. may take steps for service of notice upon the respondent through concerned P.S. by DASTI service within 7(seven) days.

Necessary steps may be taken by the prosecution accordingly.

In the mean time, call for the relevant case record from the Learned Special Judge, Sepahijala District, Sonamura in connection with Special(NDPS) No.85 of 2023.

Case Diary also may be called for from the I/O.

Learned P.P. may produce the Case Diary on the next date.
