Judgment
The learned Government Counsel frankly informs that the decision as rendered in the case of Bheem Singh Vs. State of Rajasthan & Anr. (SBCWP No. 3284/2005) on 17.01.2007 relying upon by the learned Single Judge while passing the impugned order dated 15.07.2009, has since attained finality inasmuch as the petition for special leave to appeal as preferred by the appellants before the Hon''ble Supreme Court has, according to the instructions available with him, been dismissed on 06.01.2010.
By the impugned order, the learned Single Judge while relying on the decision in Bheem Singh''s case (supra), has held that the benefit of selection grade upon completion of 9 years of service by an employee could not be denied or deferred only on account of punishment of censure having been awarded to him.
We do no find any error in the order as passed by the learned Single Judge and find no reason to show any interference particularly when the earlier decisions covering the issue are said to have been attained finality.
The appeal fails and is, therefore, dismissed.
