The present restoration application has been filed for restoration of the review petition {S.B. Review Petition (Writ) No.180/2011} which was dismissed vide order dated 09.07.2019 for non-prosecution.
On 09.07.2019, while dismissing the review petition it was observed by the Court that vide the review petition filed on 23.09.2008, review of the order dated 28.01.2008 was sought. The review petition was filed on 23.09.2008 and till the year 2019, even after a lapse of 10 years, the defects in the review petition were not cured. In view of the said observation, the review petition was dismissed for non-prosecution.
The present restoration application has been filed with a delay of four days which is condoned. However, this Court finds no ground to restore the review petition.
Even a perusal of order dated 28.01.2008 of which the review has been sought makes it clear that vide the said order, the petitioner was directed to be granted admission in the course of B.S.T.C. It is quite natural that by efflux of time, the relief prayed for in the present review petition has lost its efficacy.
In view of the above observations, the present restoration application is dismissed.
