Judgment
This writ petition has been filed by the State and District Collector aggrieved against the order dated 10.02.2017 (Annex.7) passed by the State Level Screening Committee of the Social Justice and Empowered Department, Government of Rajasthan, Jaipur.
The respondent No.1 was declared successful in the Direct Recruitment for Patwari Examination, 2011 in the category of ST(TSP). The respondent No.1 had participated in the competitive examination on the basis of caste certificate bearing Sr. No.21121 dated 18.08.2008 issued by the Tehsildar, Jhadol.
A revised result was issued on 05.05.2012, wherein it was held that the respondent No.1 did not belong to the category of ST and as such, he was excluded from the list of selected candidates. The respondent No.1 filed SBCWP No.4983/2012, which came to be decided by this Court on 03.01.2014, whereby the District Collector, Udaipur was directed to hold an inquiry in the matter and take disciplinary action against the concerned Tehsildar, Jhadol, who held the office on 18.08.2008 under Rule 16 of the Rajasthan Civil Services (Classification, Control and Appeal) Rules, 1958 and criminal action against the respondent No.1 and the Tehsildar by filing FIR. It was directed that if the caste certificate issued in favour of the respondent No.1 was found to be genuine, the Tehsildar, who issued the subsequent report would be proceeded against.
Based on the said directions, the order was passed on 31.08.2016 by the committee under the Chairmanship of the Collector attended by the District Collector, Additional District Collector, Chief Executive Officer, Zila Parishad and SDO, Jhadol, wherein the following determination without any discussion whatsoever was made :-
"प्राप्त सभी दस्तावेजों का बैठक में चर्चा के पश्चात् तहसीलदार झाडोल द्वारा जारी जाति प्रमाण पत्र क्रमांकः 21121 दिनांक 18.08.2008 को सर्वसम्मति से निरस्त करने का निर्णय लिया गया है। उक्तानुसार उक्त प्रमाण पत्र एतद्द्वारा तत्काल प्रभाव से निरस्त किया जाता है।"
Feeling aggrieved, the respondent No.1 filed an appeal before the State Level Committee, the said Committee by its order dated 10.02.2017, inter-alia, came to the following conclusion :-
"जिला स्तरीय छानबीन समिति द्वारा पारित निर्णय दिनांक 03.10.2016 तथा श्री धरम सिंह गरासिया पुत्र श्री प्रताप सिंह द्वारा प्रस्तुत किए गए अपील जबाव का राज्य स्तरीय छानबीन समिति द्वारा परीक्षण किया गया एवं श्री धरम िंसंह गरासिया पुत्र श्री ्रताप सिंह को मौक्षिक रूप से सुना गया। तत्परान्त राज्य स्तरीय छानबीन समिति का यह अभिमत है कि श्री धरम सिंह गरासिया पुत्र श्री प्रताप सिंह को तहसीलदार झाडोल द्वारा जारी किए गए अनुसूचित जनजाति प्रमाण पत्र क्रमांक विविध/2008/2121 दिनांक 18.08.2008 के सम्बन्ध में तथ्य यह है कि किसी भी व्यक्ति का जाति प्रमाण पत्र गृह मंत्रालय भारत सरकार के पत्रांक 12025/2/76-एससीटीवी-1 दिनांक 22 मार्च 1977 के अनुसरण में तथा राज्य सरकार द्वारा जारी दिशा निर्देश 09.09.15 एवं 20.10.15 के आधार पर जारी किया जाता है उक्त दिशा निर्देश के अनुसार किसी भी व्यक्ति का जाति प्रमाण पत्र सक्षम अधिकारी द्वारा आवेदक के पैतृक/स्वयं के राजस्व रिकार्ड आदि में उसके जाति का परीक्षण करवाने पश्चात एवं इसके अतिरिक्त यदि आवश्यक हो तो शैक्षणिक रिकार्ड/नगरपालिका/ग्राम पंचायत के रिकार्ड का भी जांच/परीक्षण किया जाता है। जिसमें उसके स्वयं/पैतृक जाति की पुष्टि होती हो। प्रार्थी द्वारा प्रमाण के लिए अपीलार्थी ने कक्षा 8 की वर्ष 2000 की मार्कशीट, अपीलार्थी ने सेकेण्डरी की वर्ष 2003 की मार्कशीट, अपीलार्थी ने सीनियर सेकेण्डरी की वर्ष 2005 की मार्कशीट, अपीलार्थी ने स्वयं का ग्राम पंचायत कानपुर पंचायत समिति खैरवाडा द्वारा जारी मेरिज सर्टिफिकेट क्रमांक 02 दिनांक 10.01.2012, अपीलार्थी के आय प्रमाण पत्र दिनांक 19. 02.2003, अपीलार्थी का मूल निवास प्रमाण पत्र दिनांक 20.02. 2003, मेवार सेटलमेंट डिपार्टमेंट द्वारा जारी अपीलार्थी के ग्रेट ग्रेट फादर श्री धन्ना की खातेदारी रिपोर्ट, अपीलार्थी की माता श्रीमती चम्पा की खातेदारी रिपोर्ट सवंत 2070-73, अपीलार्थी के मामा श्री बाबू पुत्र श्री पुना की खातेदारी रिपोर्ट संवत 2066-69, मीरा देवी पत्नी श्री राम सिंह इन लॉज ऑफ ग्रेट ग्राण्ड फादर का रेवेन्यु रिकॉर्ड दस्तावेज तथा स्वयं धरम सिंह पुत्र श्री प्रताप सिंह की जमाबंदी संवत 2069-72, सुनवायी के दौरान राज्य स्तरीय समिति के समक्ष प्रस्तुत किये गये। उक्त समक्ष दस्तावेजों में प्रार्थी की जाति गरासिया अंकित है। अतः श्री धरम सिंह पुत्र श्री प्रताप सिंह के स्वयं के राजस्व रिकार्ड एवं ग्राम पंचायत कानपुर पंचायत समिति खैरवाडा द्वारा जारी विवाह पंजीयन प्रमाण पत्र में श्री धरम सिंह पुत्र श्री प्रताप सिंह की जाति गरासिया दर्ज है। उक्त दोनों रिकार्ड के आधार पर श्री धरम सिंह पुत्र प्रताप सिंह की जाति गरासिया होने की पुष्टि होती है। अतः श्री धर्म सिंह गरासिया पुत्र श्री प्रताप सिंह को जारी किया गया जाति प्रमाण पत्र क्रमांक विविध/2008/2121 दिनांक 18.08.2008 को वैध पाया जाता है। तथा जिला स्तरीय छानबीन समिति के निर्णय विविध/न्याय/जाति प्रपत्र/2016/4773 दिनांक 31.08.2016 को से निरस्त किया जाता है।
It is submitted by learned counsel for the petitioners that the State Level Committee was not justified in setting aside the order passed by the District Level Committee, inasmuch as, the material available clearly indicated that the respondent No.1 did not belong to ST(TSP) category and therefore, the order impugned deserves to be quashed and set-aside.
With reference to the copious material placed on record, it was sought to be emphasized that the State Level Committee was not justified in coming to the conclusion that the respondent No.1 belonged to ST(TSP) category and therefore, the order deserves to be quashed and set-aside.
I have considered the submissions made by learned counsel for the petitioners and have perused the material available on record.
This Court in the litigation initiated by the respondent No.1, based on the conflicting material pertaining to the caste of the respondent No.1 directed for inquiry by the District Collector. The District Level Committee by its order, in a wholly slipshod manner, as already quoted herein-before, came to the conclusion that the certificate dated 18.08.2008 was required to be cancelled. The material available before it was neither discussed nor any reasons were recorded for coming to the said conclusion.
The appellate authority / State Level Committee by its order dated 10.02.2017, discussing the material available before it, has given a reasoned finding for setting aside the order passed by the District Level Committee and holding that the certificate issued to the respondent No.1 was correct.
Learned counsel for the petitioners failed to point out any perversity in the order passed by the appellate authority based on the material placed on record. The fact that in certain documents indication has been made that the respondent No.1 is 'Rajput' by itself cannot be a determining factor and the appellate authority has based on the cogent material recorded the finding, which does not call for any interference under Article 226/227 of the Constitution of India.
Consequently, there is no substance in the writ petition, the same is, therefore, dismissed.
