Jaswant Singh, J.
1.Prayer through instant revision petition is made for setting aside the order dated 07.03.2009 passed by the learned Special Judge, whereby the consent to the application filed by the Petitioner-State u/s 321 of the Cr.PC seeking withdrawal of the prosecution was declined.
Learned Public Prosecutor prays for withdrawal of the present revision petition as Petitioner accept the orders passed by the learned trial court and further states that they are no longer aggrieved against the impugned order.
Learned Counsel for the Respondent has opposed the prayer of withdrawal by stating that the same is based on political consideration.
In view of the fact that present revision petition has been filed by the Petitioner-State and is no longer interested to pursue the present criminal revision, in my opinion, the prayer of the learned Public Prosecutor is liable to be accepted.
In my view no objection on behalf of the Respondent-accused can be entertained, however, needless to say the remedy, if any, available to the Respondent against the impugned order dated 07.03.2009 in accordance with law would always open for him to seek, if so advised .
Dismissed as withdrawn.
