Judgment
Regard being had to the similitude in the controversy involved in the present cases, the review petitions were analogously heard and by a common order, they are being disposed of by this Court. Facts of Review Petition No. 801/2020 are narrated hereunder.
The present review petition has been filed with a delay of 364 days. IA No. 2631/2020 is an application for condonation of delay.
Facts of the case reveal that First Appeal was preferred with a delay of 607 days and in those circumstances, this Court, keeping in view the judgment delivered by the Division Bench in the case of Oriental Aroma Chemical Industries Ltd. Vs. Gujarat Industrial Development Corporation and another reported in 2010 (3) MPLJ 506 has rejected the application for condonation of delay, meaning thereby, the delay of 607 days was not condoned, as there was no day-to-day delay explanation. Now, Review Petition has been filed for reviewing the order dated 23/7/2019 passed in F.A.No. 2420/2018 and 2424/2018. The review petition is also barred by limitation. There is delay of 364 days. Again no day-to-day delay has been explained in the review petition, except for making a bald statement that the matter became a shuttle-cock between the authorities.
Resultantly, IA No.2631/2020 is rejected.
Ex-consequenti, the review petition is dismissed.
It is needless to mention that the State Government shall be free to take appropriate disciplinary action against the Officers involved in the matter on account of the delay which has taken place, after fixing responsibility and after following the due process of law.
The connected Review Petitions also stand dismissed. A copy of the order be placed in the record of connected Review Petitions.
