Heard Mr. Y. Ashang, learned Sr. counsel assisted by Mrs. R.K. Emily, learned Dy. GA appearing for the State petitioner and Mr. Tungrei Ngakang, learned counsel appearing for the respondent at length.
Perused the application with the counter affidavit filed by the respondent.
The State petitioner filed the present petition for quashing/ setting aside the impugned order dated 11-11-2020 passed by the Ld. Special Judge (ND & PS), Senapati in Cril. Misc. (B) Case No. 14 of 2020 (Ref:- FIR No. 13(8) 2020 Senapati P.S. u/s 21(c)/60(3) ND & PS Act releasing the accused on bail.
Both the learned counsel for the parties submit at the Bar that in spite of registering the present FIR in the year 2020, the I.O. of the case failed to submit the charge sheet till date. This shows the negligence on the part of the Investigating Authority. If at all the Investigating Authority is serious enough in the case, the charge sheet might have already been filed long time back.
In the circumstances, this Court is of the view that the I.O. of the case is not interested to prosecute the respondent in the case. With this observations, the present petition filed by the State petitioner is dismissed and disposed of.
Accordingly, the present Cril. Petn. No. 9 of 2021 is dismissed and disposed of.
