The State has come up in appeal against the judgment dated 25.2.2011 in CWP(T) No. 12258 of 2008. The issue pertains to the appointment of TGT (Arts) of a candidate with B.Com. B.Ed. The main contention of the learned Deputy Advocate General is that Commerce is not taught in the school and as per the policy, the Government has not appointed any candidate with B.Com. B.Ed. as TGT (Arts). But it is stated that many persons, referred to in the judgment, had been appointed on relaxation in qualification. However, it is also to be seen that the respondent is the one, who acquired the B.Ed. qualification, after passing B.Com., in the year 1993. In that view of the matter only the learned Single Judge allowed the writ petition. We do not find any ground to interfere with the plausible view taken by the learned Single Judge. The appeal is hence dismissed, so also the pending application(s), if any.
