By way of this review petition, a prayer has been made to recall/modified judgment dated 15.10.2025, passed by this Court in CWP No.14707 of 2025.
Learned Additional Advocate General submits that though on merit, the State is not seeking the review as there is no error apparent on the face of the record, but, he submits that in Para-2 of the judgment it stands recorded that despite two opportunities reply was not filed by the State, however, fact of the matter is that on the same date, the reply stood filed in the Registry of this Court.
This Court is of the considered view that this is no ground to entertain the prayer of the petitioners-State for the reason that the Court dictated the judgment on the basis of the record before it and it is not the case of the State that the reply of the State was either on record or was handed over to the Court during the course of the hearing of the case yet the Court referred said findings.
Thus, in these circumstances, if as on the day when the judgment was dictated by the Court, if the State subsequently or simultaneously choose to file reply in the Registry of the Court and even a copy thereof was not was made available or the perusal of the Court, the burden of the said omission cannot be shifted upon the Court.
Therefore, as this Court finds no reason to concede to the request of the State, the present review petition is dismissed. Pending miscellaneous applications, if any, also stand disposed of.
