By medium of this review petition, the petitioners have sought review of the judgment passed by this Court on 28.12.2011 in CWP No. 1347 of 2011

in case titled as ‘Sh. Sudhir Kumar versus State of Himachal Pradesh and another’ on various grounds. However, one of the contentions is that

this Court while deciding the aforesaid case has wrongly relied upon the judgments of this Court in CWP No. 2864 of 2009 titled as Mohammad

Akram versus State of H.P. & another, decided on 5.5.2011; CWP No. 2466 of 2020 titled as Hem Raj versus State of H.P. & others, decided on

28.10.2010 and CWP No. 10573 of 2011 titled as Kulwant Singh versus Principal Secretary, Food, Civil Supplies & Consumer Affairs to the

Government of H.P. & others, decided on 9.12.2011, which infact pertain to the appointment of physically challenged persons against 3% quota for

disabled persons on daily wages and not contractual basis as per the provisions of the Recruitment and Promotion Rules and the copies of the

judgments have been made available to the Court which goes to indicate that these judgments, prima facie, are different from the case in hand and the

matter is required to be reviewed. Ordered accordingly.

Consequently, the review petition is allowed and CWP No. 1347 of 2011 is ordered to be restored to its original number.
