Judgment
I.A. No.1 i.e. application for cancellation of arrest warrant and release the respondents No.1 & 2 on bail.
Pursuant to our order dated 9-2-2021 the respondent No.1 Shailendra Kumar Dhruv and respondent No.2 Smt. Malti Dhruv have been arrested on 5-
4-2021 and were produced before this Court on 12-4-2021, however, due to non- availability of Bench the matter could not be taken up on the said
date.
In so far as prayer for cancellation of arrest warrant is concerned, the same has rendered infructuous due to execution of warrant, however,
considering that this is an acquittal appeal and the respondents No.1 & 2 have been arrested and are in jail for last 1 month 10 days, we are inclined to
release them on bail.
Accordingly, it is directed that the respondent No.1 Shailendra Kumar Dhruv and respondent No.2 Smt. Malti Dhruv be released on bail on each of
them furnishing a personal bond for a sum of Rs.25,000/- with one local surety in the like sum to the satisfaction of the trial Court. They shall appear
before the Registry of this Court on 9th of August 2021 and shall continue to appear before the Registry of this Court on all such subsequent dates as
are given to them, till the disposal of this appeal.
Accordingly, I.A.No.1 stands disposed of.
Consequently, I.A.Nos. 2 & 3 also stand disposed of.
