This Contempt Petition has been filed on behalf of the State of Andhra Pradesh seeking initiation of contempt proceedings against the respondents for wilful disobedience, overreaching the orders of the Court and for breach of undertaking given to this Court. The petitioner - State of Andhra Pradesh has also sought restoration of status quo ante as on 30th September, 1997 with regard to the construction of Almatti Dam and the crest gates in particular.

Counters have been filed in which the allegations of wilful disobedience have been denied. Be that as it may, in view of the developments, which have taken place subsequently and the report which has been received from the Commissioner, we do not consider it appropriate to proceed with the contempt proceedings. The Contempt Petition is, therefore, dismissed.

Rule is discharged.

So far as the record of the Contempt Petition is concerned, it shall remain with Original Suit No. 2 of 1997 as there are certain documents which may require reference in O.s. 2 of 1997.
