ORDER
It is seen that, this application was filed under Section 95 of the IB Code, 2016 for initiation of Insolvency Resolution Process against the Respondent/Personal Guarantor.
Vide order dated 15.12.2021 Mr. Sunil Kumar Kedia having Registration No. IBBI/IPA-001/IP-P00028/2016-2017/10064 was appointed as IRP by this Tribunal, who submitted its report under Section 99 of the IB Code, 2016. Advance copy of the same was already served on 27.12.2021 upon the respondent/guarantor.
Further, learned counsel for the respondent/guarantor has already filed reply to the application filed under Section 95 of the IB Code, 2016 as well as the rejoinder by the Applicant/Financial Creditor.
We have heard the counsels for the applicant and for the Respondent and perused the report of the IRP.
