Judgment
This Application has been filed by the State Bank of India i.e. the Petitioner/Financial Creditor in CP(IB)No.07 of 2021, which was filed under Section 95(1) of the IBC, 2016 seeking to replace the RP Mr. Hemchandra by appointing another RP Mr. Ravindra Beleyur having Registration No.IBBI/IPA-001/IP-P00189/2017-18/10368 on the ground that the existing RP Mr. Hemchandra is in some personal medical issues.
Heard Ms. Chitra Nirmala, learned Counsel for the Petitioner and Mr. Hemchandra, learned RP who is present in person.
The CP was admitted and Mr. Hemchandra was appointed as RP to conduct the CIRP process against the Corporate Debtor vide order dated 02.12.2021 in CP(IB)No.07 of 2021.
In the circumstances and for the reasons mentioned in the Application, Mr. Hemchandra who was appointed to conduct the CIRP process against the Respondent/Personal Guarantor is discharged from all his duties and Mr. Ravindra Beleyur having Registration No.IBBI/IPA-001/IP-P00189/2017-18/10368 is appointed in his place to continue with the CIRP process against the Corporate Debtor, on the same terms and conditions and in accordance with the Code and Regulations made thereunder. The written consent in Form-A of Mr. Ravindra Beleyur is enclosed to the Application.
Accordingly I.A is disposed of.
