Judgment
ORDER
Adv. Nikita Abhyankar for the Applicant is present.
Ld. Counsel for the Applicant informs that, pursuant to order dated. 16.07.2025 passed by this Tribunal, The Janata Sahakari Bank Ltd. & Rajaram Bapu Saharaki Bank Ltd. have not provided the requisite details. In view of these submissions, we once again direct the concerned branch manager of these Banks to do the needful. It may be noted that, in case of their failure, they must appear in person on next date of hearing. A copy of this order be supplied to the Ld. Chairman/CEO of these banks by the Applicant.
The Manager of Ajara Urban Cooperative Bank Ltd. is directed to provide the details of the payments, which they claimed to have made on behalf of the Corporate Debtor out ofsums received from the Corporate Debtor. The Applicant shall supply the details of payments made by the Corporate Debtor shall be provided by the Applicant to the manager. It may be noted by the Ld. Manager that the adverse inference may be drawn by this Tribunal, in case of their non-cooperation.
Ld. Counsel for the Applicant submits that the Respondents are not appearing before this Tribunal and they have not provided the books of accounts also. We note that the Respondents have not appeared today also. In view thereof, we direct the Registrar of Companies to take notice of failure of the Respondent directors to maintain and preserve the books of in terms of Co1npanies Act, 2013 and initiate appropriate proceedings under the Companies Act, 2013. The Applicant is directed to serve a copy of this Order to the Registrar of Companies for necessary action.
The Applicant shall also be at liberty to refer this matter to IBBI for appropriate proceedings against Suspended Director for their non-cooperation during the CIRP process giving complete details of proceedings.
