ORDER
This application is filed under Section 95 of the IBC, 2016.
We heard the Learned Counsels for both sides. Prima facie, it appears to us that the deed of guarantee signed by the Respondent is a contentious issue whether it was signed prior to the disbursement of the loan or thereafter? It can be decided only during the hearing.
At this stage, the moratorium is issued. The IRP proposed by the Applicant is appointed. The IRP Mr. Sajjan Kumar Dokania, having Reg. No. IBBI/IPA-003/IP-N000150/2017-2018/11729 is directed to file a report within ten days.
The matter stands adjourned to 03.03.2022.
