ORDER
Adv. Rishi Thakur i/b ZBA appeared for the petitioner. None for the Personal Guarantor. It is brought to our notice that already IRP was appointed against the same Personal Guarantor vide order dated 09.02.2023 in C.P. No. 902 (MB) 2022 by Court No. III, Mumbai Bench. In view of the above C.P.(IB)/943(MB)2022 did not survive and is rendered infructuous. The petitioner shall be at liberty to file claim before the IRP so appointed in C.P. No. 902(MB)2022. With the aforesaid observations C.P.(IB)/943(MB)2022 is closed. All the pending IA’s/MA’s in the Company Petition become infructuous, hence shall stand dismissed. File be closed and consigned to record.
