Judgment
Dalip Singh and S.S. Kothari, JJ.—This appeal has been listed from the defect side as the Registry has pointed out that there is a delay of 255 days in filing this appeal. Though, the same is accompanied by an application u/s 5 of the Limitation Act.
We have examined the matter on merits also and heard learned Additional Advocate General.
The submission of the learned Additional Advocate General so far as merits of the appeal is concerned, the learned Single Judge in Para 4 of the judgment has directed that the benefit of selection scale to the Petitioner be granted w.e.f. 25/01/1992, whereas as per Additional Advocate General it should be w.e.f. 01/01/1998.
So far as the aforesaid submission is concerned, we find that the learned Single Judge has not directed for the grant of benefit w.e.f. 25/01/1992, it is only in terms of the Government Circular dated 25/01/1992. In case any clarification with regard to effective date is required, it would be open for the Appellant to approach the learned Single Judge in this behalf.
Subject to the above, the appeal as well as the stay application and the application u/s 5 of Limitation Act stands disposed of.
