Judgment
Mr.S.Rajashekar, learned Central Government Counsel, accepts notice for the respondents. Therefore, formal service of notice to the respondents is dispensed with.
The appeal is barred by limitation. The delay is of nine days.
The appellant-writ petitioner was transferred from Bengaluru to Vishakapatnam.
It is stated that the son of the appellant-writ petitioner is studying in the college. For the college going reason, the order of transfer of the father cannot be stayed.
The learned Single Judge did not find any mala fide in the transfer order requiring interference.
Therefore, the application for condonation of delay is dismissed. Consequently, the appeal is, also, dismissed.
However, the order of dismissal of the appeal shall not prevent the appellant-writ petitioner from making a representation to the authority concerned. If such a representation is made, the authority shall consider the same in accordance with law.
We make no order as to costs.
In view of dismissal of the appeal, I.A.1 of 2017 does not survive for consideration, and, it is, also, dismissed.
