On perusal of this application, it is evident that this Applicant has sought for impleadment of R16 to R25, but whereas no details have been provided disclosing what action of each of these Respondents triggered this Applicant to implead them as parties in MA/545/2019.
When this Bench has made these observations, the Applicant/Liquidator has stated that they have filed this application for impleadment based on the disclosures from the forensic report. It might be right that the forensic report has disclosed various fraudulent actions of each of these Respondents with regard to the affairs of the company, but to decide an application, it is bounden duty of the party to plead each of the facts of the forensic report disclosing the actions of each of these Respondents separately.
Since the Liquidator on his own having filed this application, being a layman filed this application, at his request, this MA/545/2019 is hereby dismissed as withdrawn with liberty to file fresh impleadment application on the same cause of action by furnishing the details as stated above.
Accordingly, this MA/545/2019 is hereby dismissed as withdrawn.
