Judgment
DEFICIENCY in service for supply of electricity is grievance of five villagers.
THEIR case is that in 1989 electricity was supplied to the village. However, the same continued for only seven days. The pillars were not firmly fixed as a result of which they were up-rooted on account of rain and wind. On 14.6.90 there was a cyclone. Four pillars were up-rooted. As a result, electric wires fell on agricultural lands for which cultivation was affected. On account of repeated requests and complaints, linemen came in October, 1990 only and removed the wires. As yet no steps were taken to supply of electricity on various pretexts as a result of which complainants are put to difficulty. Students of schools and colleges are notable to read and house wives are facing difficulties. Complainants state that in other surrounding villages within a few kilometres electricity is being supplied but no electricity is supplied to this village. In case line is drawn on 12 pillars, there would be no difficulties in supply. As because illegal gratification is not being paid by the complainants to persons who are in charge of supply of electricity, they are showing indifference and step motherly attitude depriving the complainants of electricity.
On receipt of notice case has been stated by the Opposite Parties. There case is due to disruption of transformer at Dhatrigadia, no electricity was supplied till 21.12.89. Thereafter, supply was resumed after replacement of the transformer; on 30th May, 1989. This delay was on account of non- availability of transformer. Shortly thereafter there was heavy cyclone on 14.6.90 and the high voltage line to the transformer was badly damaged and power supply was disrupted. After the cyclone, Junior Engineer himself went to the spot and took necessary steps immediately. It is stated that no written complaint was lodged by any consumer in the local fuse call centre. Even oral request was not made by any of them. Opposite Parties tried their level best to restore the supply line affected due to cyclone. Due to extensive damages in Khaira Block restoration took sometime. Some miscreants had also stolen 11 K.V. conductor on 28.6.90 within a fortnight of the cyclone. F.I.R. was lodged. Again another conductor was stolen from the village on 29.7.90 and necessary F.I.R. has been lodged. Thus, on account of situation beyond their control, supply of electricity could not be made earlier.
MR. B.R. Sarangi, learned Counsel for the Opposite Parties has brought to our notice that electricity has been supplied to the village and it is stated that adequate steps shall be taken in future no sooner grievance is made. In view of assurance made by Mr. Sarangi on behalf of Opposite Parties and in view of the facts that the non-supply was on account of circumstances beyond control, we are not able to come to conclusion that there is deficiency in service.
IN the result, there is no merit in this complaint which is dismissed. Complaint dismissed. ________________
