This petition is filed by accused Nos.1 to 5 under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) praying to quash the proceedings in C.C No.40784/2024 pending on the file of XXXII Additional C.J.M Bengaluru registered for the offences punishable under Sections 363, 366, 342, 506 read with 34 of IPC. On the complaint of respondent No.3, a case came to be registered against petitioner Nos.1 to 4 in Crime No.32/2024 in North Women Police Station Bengaluru, Bengaluru City for the offences punishable under Section 363 of IPC. The police after investigation filed a charge-sheet against the petitioners for the offences under Sections 363, 366, 342, 506 read with 34 of IPC. On the basis of the said charge-sheet case came to be registered against the petitioners in C.C No.40784/2024 pending on the file of XXXII Additional C.J.M, Bengaluru.
The proceedings in the said case are sought to be quashed in this petition.
The petitioner No.1 and respondent No.2 are present. Joint affidavit of petitioner No.1 and respondent No.2 is filed along with copy of Adhar Cards of petitioner No.1 and respondent No.2.
Respondent No.2 submits that she was in love affair with petitioner No.1 and now after attaining the age of 18 years, she has married petitioner No.1 and their marriage has registered on 25.02.2025. The certificate of registration of Hindu Marriage dated 25.02.2025 is enclosed with the petition. The date of birth of the victim as per Adhar Card and her school certificate is 30.05.2006, the date of birth of the petitioner No.1 as per his Adhar Card is 01.04.1996.
Petitioner No.1 submits that he has married respondent No.2 on 23.02.2025 and their marriage has been registered on 25.02.2025.
Respondent No.2 submits that she has no objection for quashing the proceedings against the petitioner. Respondent No.2 submits that she is residing with her husband i.e., petitioner No.1 at his house.
In view of the settlement of the matter and marriage of petitioner No.1 with respondent No.2, the proceedings against petitioners in C.C No.40784/2024 is pending on the file of XXXII Additional C.J.M Bengaluru are quashed.
Accordingly, the petition is disposed of.
