Heard the learned counsel appearing for the appellants and learned counsel appearing for the respondent no. 1. The claim petition has been dismissed by the XXIV Additional Small Causes Judge and MACT in MVC. No. 6307/2009 on the ground that the relationship is not established. In this regard, the submission of the learned counsel appearing for the appellants is that in a connected matter, this Court has remanded the matter to afford opportunity to the claimants - appellants to establish the relationship and for disposal of the case in accordance with law.

In view of the statement made, impugned order of dismissal of the claim petition is set aside. The matter is remitted back to the Tribunal permitting the claimants - appellants to adduce additional evidence. All contentions are left open. The Tribunal to dispose of the case in accordance with law after affording opportunity to the claimants. The matter shall be disposed of by the Tribunal within a period of six months from the date of receipt of a certified copy of the order. Accordingly, the appeal stands disposed of.
