Judgment
This petition was registered on the basis of a letter received by the Court regarding illegalities in grant of lease in respect of Dolamite mines which then was a major mineral.
The petition was admitted on 2nd December, 2002 and Mr. Kar was appointed as Amicus Curiae on 4th April, 2003. Thereafter it was listed 23rd April, 2003. From then on till date i.e. for over a period of eighteen years the petition was not listed once. In the meanwhile, with effect from 10th February, 2015 Dolamite was declared to be minor mineral.
A counter affidavit was filed on 9th January, 2003 by the Assistant Mines Officer, Rourkela maintaining that no illegality has been committed in the allotments made. This is, however, contested by Mr. Kar.
Nevertheless at this stage, more than 18 years after the petition was registered, and with no orders having been passed for over 18 years the Court does not consider it appropriate to interfere in the matter.
The writ petition is disposed of.
