Heard Mr. B. Singh, learned counsel for the Appellant and Mr. P.K. Mishra on behalf of Mr. B.C. Singh, learned counsel for the Respondent No.2.
There is delay of 1035 days in filing the appeal.
This is a case of injury and the claimant has come up praying for enhancement of the compensation amount. It is explained that the injured went in depression and mental imbalance after sustenance of injury and as such, delay occurred in preferring the appeal. But on perusal of the record, it reveals that the injured-claimant is a young man, who has received the award amount in due time granted by learned Tribunal. Therefore, the contentions that he went in depression is found unbelievable on the face of the facts. The explanations offered and reasons stated to condone the delay are not found satisfactory. As such, this Court is not inclined to condone the delay.
The M.C. is dismissed. Consequently the appeal is dismissed on the ground of limitation.
