Judgment
The petitioner is before this Court seeking for the following reliefs:
a. Issue a Writ of Certiorari or any other appropriate writ quashing the Enquiry Report dated 18.05.2024 conducted by Respondent No.4, vide Annexure-A, based on complaint given by petitioner vide Annexure-B, in so far as petitioner concerned.
b. To pass such other orders as this Hon'ble Court deems fit to pass in the circumstances of the case, in the ends of justice.
The grievance of the petitioner is that the complaint which had been lodged by the petitioner against respondent No.7 has not been considered in a proper manner and without a proper investigation being made, a report has been submitted at Annexure-A rejecting the complaint which have been made without any reasons being assigned thereto.
A perusal of the complaint at Annexure-F indicates that there are several complaints which have been made in respect to the functioning of respondent No.7-Institution. Juxtaposing the said complaint with the report at Annexure-A it is seen that all those issues have not been considered in the said report.
In that view of the matter, the report cannot be accepted. As such this Court passes the following;
ORDER
The writ petition is allowed.
A certiorari is issued, the enquiry reported dated 18.05.2024 submitted by respondent No.4 at Annexure-A is set aside.
The matter is remitted to respondent No.4 for fresh consideration.
Respondent No.4 shall consider all the allegations which have been made in the complaint submitted by the petitioner as also the defences of respondent No.7 and submit a detailed enquiry report as required under law within a period of 60 days.
The petitioner would be entitled to submit any other and further document that the petitioner wishes to submit by 18.09.2026. The respondent No.7 would be entitled to submit his written objections as also the documents that respondent No.7 wishes to rely upon by end of day 30.09.2026.
The period of 60 days shall be calculated from 30.09.2026.
