This petition is filed seeking bail in Crime No. 94/2011 of Gubbi Police Station registered on 07.06.2011 for the offences under Sections 149, 304B, 498A and 302 IPC. On completion of the investigation, charge sheet is filed for offences under Sections 498A and 304B r/w. Section 34 IPC.
Heard Sri H.L. Jayaramu, learned Counsel for the petitioners and Sri Vijaya Kumar Majage, learned HCGP for the respondent State.
Learned HCGP opposes the application for bail and submits that CW. 11 Vasantha, CW. 12 - Shiva Kumar, CW. 13 - Kumar and CW. 14 Maruthi who are the neighbours of the accused have given statement to the effect that the first petitioner was demanding money after the marriage and the death took place immediately thereafter. However, these allegations are directed against the husband of the deceased Shiva Kumar. Hence, he prays that the petition may be dismissed.
I have gone through the materials on record. In view of the fact that there are no allegations of demand for additional dowry soon before death against petitioner No. 2, the petition is partly allowed. Petition is dismissed in respect of petitioner No. 1 - Sri Shiva Kumar and the petition in respect of the petitioner No. 2 Muralidhara is allowed on the following conditions:-
a. The petitioner No. 2 is directed to be released on bail on his executing a bond for Rs. 25,000/- with one surety each for the likesum to the satisfaction of the Court below.
