ORAL ORDER

This petition is challenging the order of externment passed under Section 56(g) of the Karnataka Police Act, 1963, in terms of which petitioner has placed to report at Raichur District.

Counsel for petitioner submits that petitioner has been acquitted of all the criminal cases and no criminal case is pending against him.

3.

Learned AGA submits that the order impugned is appealable under Section 59 of the Karnataka Police Act.

Section 59 of the Karnataka Police Act reads as under:

“59.

Appeal: Any person aggrieved by an order made under section 54, 55 or 56 may appeal to the Government within thirty days from the date of such order.”

In that view of the matter, reserving liberty to the petitioner to avail the remedy provided under Section 59 of the Karnataka Police Act, petition is disposed of.

6.

There shall be stay of the impugned order, if not already executed for a period of 15 days from today.

7.

The Appellate Authority shall while considering the appeal take cognizance of the fact that petitioner is stated to have been acquitted of the criminal cases filed against him.
