S.N. Satyanarayana, J.—The claimant in CWC-3/NFC/CR-87/2003, dated 11.09.2007 on the file of the Commissioner for Workmen Compensation, Bangalore Division - III at Bangalore has come up in this appeal seeking enhancement of the compensation awarded by the Commissioner for Workmen's Compensation for the injuries suffered by him in a road accident, which has taken place on 15.10.2003.
The award passed by the Commissioner clearly discloses that the claimant has suffered rupture of small intestine to an extent of 12 cms., which are resected and anatomized by the Doctor through laprotomy surgery and thereafter the same Doctor has given evidence before the Commissioner stating that the said injury has caused whole-body disability to the claimant to an extent of 10%.
Considering the fact that the said injury is non scheduled injury, the Commissioner has assessed the compensation taking the loss of earning capacity to the claimant to an extent of 20%. Taking his salary at Rs. 4,000/-. per month compensation in a sum of Rs. 76,704/- is awarded to him.
On perusal of the reasoning and findings given thereto, it is seen that the compensation awarded by the Commissioner is just and proper and does not call for interference by this Court in this appeal. Therefore, it does not call for admission of this appeal for consideration. Hence the same is dismissed.
