Judgment
D.K. Trivedi, J.—The present petition is under Section 482 Cr. P.C. against the order dated 5111984 passed by the Distt. and Session Judge, Hardoi in Criminal Revision No. 51/84 dismissing the revision in the absence of the applicant.
No doubt the revision was dismissed on merits also but as the revision was dismissed in the absence of the Counsel, hence I quash the said order and direct the parties to appear before the Magistrate concerned. The Magistrate concerned has only passed an order attaching the property in question. It is not disputed that property in question has already been attached. The order of the Magistrate concerned is dated 541984 and since then about nine years have been passed.
In these circumstances, I direct the petitioner to appear before the Magistrate concerned and move an application to the effect that there is no apprehension of breach of peace. If the petitioner moves the said application then the Court concerned will do the said question of apprehension of breach of peace and after deciding the same, he will proceed in accordance with law.
With these observations the petition is disposed of finally. Petition disposed of.
