Heard the learned counsel for the parties.
FIR in Crime No.250/2026 was registered by Kengeri Police Station, Bengaluru, for the aforesaid offences against the petitioner herein and his sister based on the first information dated 04.06.2026 received from victim girl, aged 24 years. In the said case, petitioner herein was arrested on 04.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.8851/2026 was rejected on 23.09.2026. Therefore, he is before this Court.
A reading of the first information would reveal that petitioner aged 22 years and the victim girl were in love for the last one and half years. Victim girl has also stated that they both had spoken about their marriage. Subsequently, petitioner had taken the victim girl to his house and had introduced her to his elder sister. On the said day, after the elder sister of the petitioner left the house, petitioner allegedly had sexual intercourse with the victim girl with a promise to marry her. Subsequently, on multiple occasions, he had sexual intercourse with her and as a result, the victim girl had conceived. Thereafter, her pregnancy was terminated in a Hospital at Jagajeevanram Nagar. It is alleged that subsequently, petitioner had refused to marry the victim girl and therefore, FIR was registered against the petitioner and his sister, who also had allegedly promised to perform their marriage.
Investigation of the case is now completed and charge sheet is filed. Petitioner is a student pursuing his final year BA degree course. The maximum punishment for the alleged offences is imprisonment for a period of ten years. Material on record would go to show that petitioner and the victim girl were loving each other and they had consensual sex. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:-
The criminal petition is allowed. The petitioner is directed to be enlarged on bail in SC No.1207/2026 pending before the Court of LIII Addl.
