Judgment
Draft issues have been filed on behalf of the parties which are available on record of the case. Heard the learned counsels appearing on behalf of the parties and perused the record of the case. In the light of the material available on record of the case, the following issues are settled:
ISSUES
Whether the instant petition is maintainable in its present form ?
Whether the notice dated 25.1.2021 issued by Respondent No.1 to the Petitioner is liable to be set aside ?
Whether Respondent No.1 has disconnected the local channel of the Petitioner namely "IAHD" in breach of the Interconnect Regulations, 2017 and the Quality of Service Regulation, 2017 ?
Whether the Petitioner is the exclusive and only authorized MSO of Respondent No.1 in the area of operation assigned to the Petitioner ?
Whether Respondent No.1 has breached its obligation under the agreement dated 21.1.2019 ?
Whether the Respondents have damaged the equipment and / or wiring of the Petitioner in the area of operation assigned to the Petitioner ?
Whether the Respondents are liable to pay damages to the Petitioner ?
Whether the Petitioner is entitled to any other relief / reliefs ?
Six weeks time is prayed and allowed to the Petitioner for filing their evidence affidavits. The Respondents may file their evidence affidavits within six weeks thereafter. Let the matter be listed on 2nd September, 2022 for directions.
