V. Jagannathan, J.—Heard the leaned Counsel for the Petitioner and also the learned Addl. SPP for the State in respect of the anticipatory bail sought by the Petitioner against whom and others, a case is registered in Cr. No. 253/10 by Nandini Layout police Bangalore for the offences punishable under Sections 3, 4 & 5 of the Price Chits and Money Circulation Schemes (Banning) Act, 1978 & Section 420 of IPC

Submission of the Petitioner''s Counsel is that, the only allegation against the Petitioner is that he being the owner of the premises in question, he is said to have allowed the premises for being used by M/s. UNIPAY 2U INTERNATIONAL INVESTMENT PACKAGE for the business transaction and except this, there are no allegations against the Petitioner.

Submission of the learned Addl. SPP for the State is that, the Petitioner being the owner of the house in question has also involved in the alleged offences and investigation is pending.

Having regard to the above submissions made and the report filed toy the Inspector on 21.12.2010, mentioning at the end of the report that the Petitioner herein had given the premises on rent to the other accused persons, I am of the view that the Petitioner can be granted the benefit of anticipatory bail on the condition that he should co-operate with the investigating agency and assist them during investigation.

In the result, petition is allowed and anticipatory bail is granted to the Petitioner, subject to the following conditions:

(i) Petitioner shall be released on bail in the event of his arrest in Cr. No. 253/10 by Nandini Layout police on his executing a personal bond for a sum of Rs. 25.000/- with two sureties for the likesum to the satisfaction of the arresting police officer.

(ii) He shall not tamper with the prosecution evidence.

(iii) He shall not five threat to the prosecution witnesses is any manner.

(iv) He shall co-operate with the investigating agency and assist them during investigation and shall appear before the I.O. as and when be is called upon to do so.

(v) He shall mark his attendance before the jurisdictional police station on every Sunday between 10 a.m. and 5 p.m.
