Appeal is by the claimant seeking enhancement of compensation as against the award passed by the Additional MACT and Principal Civil Judge (Sr.Dn), Ramanagara in MVC No. 301/2009 on 31.3.2010.
The claimant has sustained Injuries in the motor vehicle accident that occurred on 29.12.2003 around 11.15 a.m. due to the negligence of the driver of the offending vehicle (KSRTC bus). The Tribunal, having held that the accident occurred due to the negligence on the part of the drivar of the bus bearing Reg. No. KA-42-F-031. awarded compensation of Rs. 3,500/- with Interest at 6% p.a. fastening liability on the Insurer. Being aggrieved, the claimant is before this Court
Heard the counsel for the respective parties.
Having regard to the nature of injuries sustained, the claimant is entitled for another sum of Rs. 10,000/- over and above the compensation awarded be the Tribunal with interest at 6% p.a. from the date of petition till deposit.
Amount shall be deposited within three months.
Appeal is allowed in part.
