Judgment
HON’BLE MR. JUSTICE BISWAJIT PALIT
This writ petition is filed by the petitioner seeking the following reliefs:
(i)Issue notice upon the Respondents,
(ii)Call for the records,
(iii)Issue rule calling upon the Respondents to show cause as to why the Petitioner shall not be recommended for appointment against any SC post of Special Educator under the Directorate of Secondary Education, Govt. of Tripura notified by Notification dated 10.02.2025 issued by Respondents No.2-4.
AND
Issue rule calling upon the Respondents to show cause as to why the action of the Respondents in verbally rejecting the candidature of the Petitioner for the post of Special Educator notified Vide Notification dated 10.02.2025 at the time of verification of the marksheets, documents etc of the Petitioner shall not be held to be illegal and set aside.
AND
iv) After hearing the parties be pleased to make the rule absolute.
AND
Pass any other order/orders as deemed fit and proper.
Heard Learned Counsel, Mr. A. Bhaumik assisted by Learned Counsel, Ms. I. Chakma appearing on behalf of the petitioner and also heard Learned Senior G.A., Mr. P. Gautam appearing on behalf of the State-respondents.
Taking part in the hearing, Learned Counsel for the petitioner first of all drawn the attention of the Court that the petitioner completed his Bachelor of Arts degree in the year 2004-2005 and secured 33.57% marks. Thereafter, he applied for B.Ed (Special Education) course from NEHU in 2014-16 and got admitted therein filing requisite fees and attended classes and on 15.09.2014 the induction program was held and the classes were started w.e.f. 16.09.2014. Thereafter, he completed his B.Ed (Special Education) program from said NEHU and obtained Second Division. In this regard, he relied upon Annexure-5 & 6 and also relied upon the certificate issued by the Vice Chancellor (Annexure-7). It was further submitted that as the petitioner could not secure good marks, so, he further conducted graduation program from Rabindranath Tagore University and secured 68.80% marks (Annexures-8, 9 and 10). After that the TRBT issued one advertisement on 10.02.2025 (Annexure-11) and in the said notification the TRBT invited online application for selection of candidates for recruitment to the post of Special Educator and in the said recruitment process there were in total 112 nos. of posts. Out of that 28 posts were reserved for URs, 30 posts were SCs and 54 posts were for STs Candidates. Learned Counsel further submitted that the petitioner is a SC candidate. He accordingly, applied for the said post and the TRBT issued Admit Card and he appeared in the selection test and thus, he obtained 89 marks (Annexure-2) out of 150 (Annexure-13). But TRBT issued one notification on 21.08.2025 (Annexure-14) for verification of mark sheets. The petitioner was also appeared to the authority at the time of verification of mark sheets when his candidature was rejected on the ground that he did not have the requisite qualification of 50% marks and also his certificate was not recognized under Rehabilitation Council of India. Hence, he filed the writ petition.
At the time of hearing, Learned Counsel in addition to his submission also relied upon e-registration certificate issued by the Rehabilitation Council of India (Annexure-15) which was valid upto 28.06.2030 commencing from 05.03.2020 and the said certificate was renewed on 30.06.2025 printed on 03.07.2025. It was further submitted that his initial certificate of registration under Rehabilitation Council of India was valid w.e.f. 05.03.2020 for a period of 5 years and thereafter, he applied for renewal on 21.02.2025 and finally, renewal certificate was issued till 28.06.2030 showing renewal date on 30.06.2025. Referring the same, he submitted that there was no scope on the part of the TRBT that he did not have any valid registration certificate. It was further submitted that Rehabilitation Council of India issued one regulations on 15.05.2015 (Annexure-16) wherein in Clause-5.2 it was mentioned as under:
“5.2 Eligibility
(a)Candidates with at least fifty percent marks either in the Bachelors Degree and/or in the Masters degree in Sciences/ Social Sciences Humanities, Bachelor's in Engineering or Technology with specialization in Science and Mathematics with 55% marks or any other qualification equivalent thereto, are eligible for admission to the programme.
(b)The reservation and relaxation for SC/ST/OBC/PWD and other categories shall be as per the rules of the Central Government/ State Government, whichever is applicable.
(c)However, weightage to be given to the candidates fulfilling any one of the following conditions:-
1.Parent of a child with disability
2.Person with disability possessing Disability Certificate issued by the Competent Authority
3.Possession of any RCI approved diploma/degree”
Further, he also referred point No.23 wherein it has been also mentioned as under:
“23. Norms for Regular Faculty at the University Head Quarter
The existing faculty norms (2010)- sl.no 15 will be applicable only for the first year of the academic session 2015-16. Revised norms will be applicable from the academic session 2016-17 onwards (second year of the course starting in 2015-16). Information with regard to appointment of faculty to be submitted to the Council.”
Referring the same, Learned Counsel also submitted that the revised norms will be applicable from the Academic Session 2016-17 onwards and the 2nd year of the course starting on 2014-16 but the present petitioner enrolled himself in B.Ed (Special Education) under ODL mode during the Academic Session 2014-16 and in view of the said regulation, there was no restriction for a candidate to have 50% marks for admission to B.Ed, Special Education Course (ODL Course) and furthermore, Learned Counsel also submitted that since the TRBT has not disputed his subsequent graduation degree, so, the TRBT at this stage cannot reject his candidature for recommendation for appointment to the post of Special Educator. So, in summing up, Learned Counsel urged for allowing this writ petition.
This writ petition has been contested by the State-respondents. In para Nos.5, 6 and 7 the State-respondents have made the following assertions:
“5.That, with regard to paragraph-I to 5 of the writ petition, I humbly submit that, That the averments made by the petitioner in para nos. 1 to 5 of this writ application, the answering respondent submit that these are matter of records pertaining to the locus standi, territorial limits and 'cause of action' and are to be decided by the Hon'ble Court.
The petitioner failed to produce the valid RCI registration certificate(professional qualification) at the time last date of the submission of the online application. And hence the fact that the candidature of the petitioner was cancelled solely on the fact that Petitioner did not have 50% marks in his Graduation at the time of enrollment in his B. ED (Special Education) course is not true.
6.That, with regard to paragraphs- 6 to 12 of the writ petition, I humbly submit that, in response to the averments as stated in these paras, the answering respondent states that as per the curriculum Framework of Bachelor of Education- Special Education (B.Ed. Spl Ed) Norms, Regulation & Course content, RCI (Rehabilitation Council of India) always maintain parity with the NCTE recommended framework so as to facilitate the role requirement of the special teachers for all types of school.
A copy of the Curriculum Framework is enclosed herewith and marked as Annexure-A.
NCTE vides its 2009 Regulation and 2014 Regulation has mandated the requirement of at least fifty percent marks in the senior Secondary (+2) or its equivalent examination for eligible for admission. Whereas the petitioner had only secured 33.57% marks in graduation and with this graduation marks he got admission in NEHU, for obtaining B.Ed. (Special Education) degree.
It is also pertinent to state here that
(a)vide notification no- No.F.2[1-18) GEN/TRBT/REC/2024/246, Dated 10/02/2025, TRBT has invited online application from 07.03.2025 to 17.03.2025 from Indian Nationals having permanent residence in Tripura for selection of candidates for recruitment to the post of "Special Educator" through "Selection Test for Special Educator (STSE) - 2025" under Secondary Education Directorate, Education (School Department), Government of Tripura. In second para of page -5 of the notice was mentioned that "candidates must be in possession of minimum required qualification and mark sheets)/certificate of the academic and professional qualification as on the last date of submission of online application i.e., 17.03.2025.
A copy of the Notification No.2(1-18) GEN/TRB/REC/2024/246 dated 10/02/2025 is enclosed herewith and marked as Annexure-B.
(b)And also, in the Notification and prospectus cum instruction for STSE published on i.e., 10/02/2025.
The Essential Minimum qualification required is
(i)50% marks either in Graduation or in Post-Graduation from a recognized university with B.Ed. special Education or its equivalent Rfrom a RCI recognized institution and must be registered with RCI.
A copy of the Prospectus-Cum-Instructions: Selection Test For Special Educator(STSE) 2025 is enclosed herewith and marked as Annexure-C.
But at the time of verification of documents the petitioner has furnished the Registration certificate of RCI issued on 30.06.2025, which is beyond the last date of submission of online application i.e., 17.03.2025 as mentioned in the notification.
A copy of the e-Registration Certificate is enclosed herewith and marked as Annexure-D.
7.That, with regard to paragraphs- 13 to 14 of the writ petition, I humbly submit that, in response to the averments as stated in these paras, the answering respondent submits that it is a fact that the petitioner has secured 89 out of 150 in the selection Test for Special Educator (STSE-2025) and accordingly, he appeared on the date of Scrutiny i.e., 28/08/2025 in pursuance of Notice dated 21/08/2025. At the time of scrutiny, like other petitioners, he showed all marksheets/certificates of both academic and professional qualification and in no way, he was denied verbally As per the curriculum Framework of Bachelor of Education- Special Education (B.Ed. Spl Ed) Norms, Regulation & Course content, RCI (Rehabilitation Council of India) always maintains parity with the NCTE recommended framework so as to facilitate the role requirement of the special teachers for all types of schools.
NCTE vide its 2009 Regulation and 2014 Regulation has mandated the requirement of at least fifty percent marks in the senior secondary (+2) or its equivalent examination for eligibility for admission. Whereas the petitioner has secured only 33.57% marks in graduation.”
However, Learned Senior G.A. at the time of hearing of argument submitted that the petitioner could not obtain 50% marks in his graduation program and as such his case was not considered. It was further submitted that he did not have any valid registration of the Rehabilitation Council of India and he furnished the registration certificate of his RCI issued on 30.06.2025 which is beyond the last date of submission of online application i.e. on 17.03.2025 as mandated in the notification. So, Learned Senior G.A. in summing up of his submission prayed for dismissal of the writ petition.
Heard both the sides. Perused the writ petition and the documents annexed with the same as well as the counter-affidavit filed by the State-respondents along with the document. Admittedly, the TRBT vide notification dated 10.02.2025 (Annexure-11) invited applications for selection of candidates for recruitment to the post of Special Educator (ST/SC 2025) under Secondary Education, Directorate, Education, School Department, Government of Tripura and in the said notification in respect of essential minimum qualification the following conditions were prescribed:
“1. Essential Minimum Qualification:
(a)50% marks either in Graduation or in Post-Graduation from recognised university with B.Ed. (Special Education) or its equivalent from a RCI recognized institution and must be registered with RCI.
Desirable: Having Knowledge of Bengali or kokborok.
NB: Relaxation up to 5% in the qualifying marks will be allowed to the candidates belonging to SC/ST /PH category.”
In the said notification it was also mentioned the last date for submission of online application was 17.03.2025. From the aforesaid essential qualification, it also appears that a candidate should have 50% marks either in the graduation or post-graduation from recognized University with B.Ed (Special Education) or its equivalent from a RCI recognized Institution and must be registered with RCI with further condition that relaxation upto 5% in the qualifying marks will be allowed to the candidates belonging to the SC/ST/PH Category. The petitioner is a SC candidate. He accordingly, applied for the post and secured 89 marks out of 150. This has not been disputed by the respondent. It is also admitted by the petitioner that in the year 2004-2005 he obtained his graduation (3 years Degree Course) from Tripura University and secured 33.57% which his less than 50%. Thereafter, in the year 2023 he further obtained his graduation degree in Arts from Rabindranath Tagore University and secured 68.80% and prior to that he got admitted in B.Ed Special in Education from NEHU during the Academic Year-2014-2016 and granted the degree of Bachelor Education in Special Education through Distance Education with specialization area of visual impairment and obtained the degree from said North Eastern Hill University. The TRBT issued the notification for online application on 10.02.2025, so, prior to that he obtained his two graduation degrees and B.Ed in Special Education during the Academic Session 2014-2016. The State-respondents in their counter-affidavit stated that as the petitioner secured 33.57%, so, he was not eligible. But the fact that in the subsequent graduation program he obtained 68.60%. The State-respondents in their counter-affidavit stated that as per NCTE guidelines of 2009 and 2014 regulation, 50% marks in the Senior Secondary Level or its equivalent examination for admission. But surprisingly, in the notification of the TRBT through which the TRBT invited online application, nowhere it has been mentioned that NCTE guidelines would be applied in the present case, rather it has been specifically mentioned that the B.Ed (Special Education) should be from a RCI recognized Institution and must be registered with RCI. Rather, the State-respondents relied upon the regulations of Rehabilitation Council of India wherein the regulation of Rehabilitation Council of India which was published on 15th May, 2015 in para No.5.2 specifically mentioned that atleast 50% marks would be required either in the Bachelor Degree or in the Master Degree in Sciences, Social Sciences, Humanities, Bachelors in Engineering or Technology with specialization in Science and Mathematics with 55% or any other qualification equivalent thereto are eligible for admission to the program, but that regulation of 2015 would be applicable only for the candidates for the Academic Session 2015-2016 and revised norms will be applicable for the Academic Session 2016-2017 onwards and the 2nd year of the course will be starting from 2015 and 2016, so, the said regulation of 2015 would not be applied in the case of the present petitioner and more so, the respondents nowhere in their counter-affidavit disputed the securing of 68.80% marks by the petitioner when he obtained subsequent degree from the Rabindranath Tagore University and the same has been specifically mentioned in para No.17. Thus, it appears that the stands taken by the respondents in their counter-affidavit and the submission made by Learned Senior G.A. appears to be contradictory to each other and furthermore, the respondents in their counter-affidavit stated that on the last date of submission of application, i.e. on 17.03.2025 the petitioner did not have any valid registration certificate under RCI. In this regard, on perusal of the rejoinder and its annexures submitted by the petitioner, it appears that he was firstly registered with RCI w.e.f. 05.03.2020 which was valid for a period of 5 years. Thereafter, he applied for renewal on 21.02.2025, i.e. prior to expiration of the said period and after that, the Rehabilitation Council of India issued one E-Registration certificate (Annexure-3) against CRR No.167426 from which it appears that his initial certificate which was issued on 05.03.2020 was valid upto 28.06.2030, although the renewal date has been shown as 30.06.2025. So, the stand taken by the respondents that at the time of online application, he did not have the valid e-registration certificate does not have any legal force. Furthermore, the respondents although in their counter-affidavit referred about the NCTE guidelines but in the annexures they also relied upon the regulation of 2015 issued by the Rehabilitation Council of India on May, 2015 which was effecting from the Academic Session 2015-2016 and as already stated that the petitioner undergo his B.Ed (Special Education) 2014-2015 Academic Session. So, the said regulation of May, 2015 also would not be applicable in the case of the present petitioner. In addition to that the petitioner as already stated applied online and thereafter, he was issued admit card by the authority and he appeared in the selection test for Special Educator (SC/ST 2025) wherein he secured 89 marks out of 150 as a SC candidate. So, it appears that the respondent TRBT after knowing the academic careers, i.e. the two graduation programmes as well as his B.Ed (Special Education) program permitted him to appear in the examination and in the counter-affidavit also nothing has been disputed by the State-respondents in this regard. At the time of hearing, Learned Counsel for the petitioner submitted that out of 112 posts as advertised, 30 posts were reserved for SC candidates and those posts could not be filled up and still there are so many posts lying vacant for want of recommendation and as such the petitioner as a deserving candidate, who has qualified the process and secured the requisite marks also be considered for recommendation for appointment to the post of Special Educator which has been arbitrarily denied by the respondents TRBT.
Learned Counsel for the petitioner also at the time of hearing referred the Rehabilitation Council of India Act 1992 and referring the provision of Sections 19 and 21 he also submitted that no step was taken by the respondents for removal the name of the petitioner from the register of the Rehabilitation Council of India.
Thus, after hearing both the sides it appears that the petitioner could make out a case for granting relief in his favour. The respondents although disputed the contention of the petitioner but by showing any documentary evidence on record they have failed to project any proper defence to discard the case of the petitioner. More so, the assertions made in the counter-affidavit by the respondents are not in-accordance-with assertions made by the petitioner it the writ petition. In one place, it was submitted that he did not have the requisite marks and in another place it was also submitted that he did not have any valid e-registration certificate under Rehabilitation Council of India but regarding the obtaining of subsequent graduation degree from Rabindranath Tagore University and also the e-registration certificate which is valid till 28.06.2030 w.e.f. 05.03.2020 nothing has been submitted by the respondents, rather they came to the observation that the subsequent e-Registration Certificate was renewed on 30.06.2025 but the fact remains the initial certificate which was issued on 05.03.2020 was valid for a period of five years and thereafter, the petitioner applied for renewal on 21.02.2025 prior to expiry. Thus, the entire stands taken by the respondents are contrary to the submission and assertions made by the petitioner.
In the result, the writ petition filed by the petitioner is allowed. The respondents are asked to recommend the name of the petitioner for appointment for the post of Special Educator under Directorate of Secondary Education, Government of Tripura against SC post within a period of 3 months from the date of passing of this judgment.
With this observation, this present petition stands disposed of.
