Judgment
M.N. Bhandari, J.—The matter has come before me in view of remand of case by the Hon''ble Division Bench. The matter is heard accordingly.
During the course of arguments, learned Counsel for Petitioner submitted that in other 19 similar matters, the Government has already taken a decision. A copy of which is placed before me showing the aforesaid. It is prayed that matter may be disposed off with a direction to the Respondents to deal with the present matter also, if it is similar to the cases already decided by the Government. A copy of government decision would be placed before the Respondents along with representation.
In view of the prayer aforesaid, the present writ petition is disposed off with liberty to the Petitioner for making a representation to the Government to brining it in their knowledge that similar matters have already been decided favourably. On submission of representation, the Respondents may dispose off the matter after considering as to whether this case is also covered by their decision in other 19 cases. In case of favourable decision, the amount, already collected from the Petitioner, would be refunded.
With the aforesaid, the writ petition is disposed off.
