Judgment
V. Jagannathan, J.—Heard both sides in respect of anticipatory bail sought by the Petitioners who are accused Nos. 1 to 3 in the case registered against them in Cr. No. 210/10 by Rajarajeshwari Nagar police, Bangalore, for an offence punishable u/s 420 of IPC.
The complaint allegations in short is that, the 1st Petitioner has sold the property bearing No. 1385 situated in the BEML Layout to the complainant under a sale deed dated 06.02.2010 and received a sum of Rs. 17,50,000/- Thereafter, the 1st Petitioner said to have executed a gift deed in favour of 3rd Petitioner who is his daughter and it was registered on 30.07.2010 and hence, the case of the complainant is that the Petitioner have committed the aforementioned offence.
Having regard to the complaint allegations and on perusal of the papers placed and the sale deed also being produced. I am of the view that Petitioner Nos. 2 & 3 can be granted anticipatory bail by imposing conditions. As far as the 1st Petitioner is concerned, he has to surrender before the trial court and seek regular bail.
in the result, petition is partly allowed and anticipatory bail is granted to Petitioner Nos. 2 & 3, subject to the following conditions:
(i) Petitioner Nos. 2 & 3 shall be released on bail in the event of their arrest in Cr. No. 210/10 of Rajarajeshwari Nagar police on each of them executing a personal bond for a sum of Rs. 25.000/- with two sureties for the likesum to the satisfaction of the arresting police officer.
(ii) They shall not hamper the investigation.
(iii) They shall not give threat to the prosecution witnesses in any manner.
(iv) They shall appear before the I.O. as and when he is called upon to do so.
(vi) They shall attend the Court on all dates of hearing.
(vi) They shall mark their attendance before the jurisdictional police station on every Sunday between 10 a.m. and 5 p.m.
Anticipatory bail sought in respect of Petitioner No. 1 is hereby rejected.
