Judgment

The present writ petition has been filed seeking direction to the respondent to immediately launch a waste and garbage disposal system in the Thandi
Sadak in Haldwani.
The petitioner has highlighted the unscientific disposal of garbage in the Thandi Sadak. This Thandi Sadak is used by the morning walkers. It is the
only stretch which is used by the morning walkers. Below the Thandi Sadak, there is a regular canal, though small in size. The entire area of this
Thandi Sadak is littered with garbage. The Thandi Sadak is also used by the transporters to park their vehicles seeking entry into the Gola River for
mining purposes. The garbage is also dumped on the road and river by eateries. They have also permitted the parking of the vehicles.
Accordingly, the present writ petition is disposed of with the following directions:
i) District Magistrate, Nainital shall ensure that the Thandi Sadak is kept clean. There shall be no dumping of waste and garbage on this road.
ii) No transport vehicle or private vehicle shall be parked on the Thandi Sadak henceforth. It shall be open for the police authorities to remove the
vehicles from the present place, if not removed by the owners and drivers themselves within 48 hours.
iii) Proper railings be fixed on both sides/ends of the Thandi sadak. Necessary steps shall also be taken for its beautification.
iv) No motorcyclist/scooterist shall be permitted to ply on this road.
v) The Superintendent of Police, Nainital is directed to ensure that the parks are not misused by the anti-social elements in Haldwani town.
