Judgment
Heard Mr. N. Ali, the learned counsel appearing on behalf of the Petitioner and Mr. K. Gogoi, the learned Additional Senior Government Advocate appearing on behalf of all the Respondents.
The case of the Petitioner herein is that the Petitioner is aggrieved by the inaction on the part of the Respondent Authorities in not making payment of the amount to which the Petitioner is entitled to.
The case of the Petitioner herein is that the Petitioner is the owner of vehicles bearing Registration Nos. AS-01-DZ-0704 (Bolero), AS-01-FZ-0749 (Bolero), AS-01-HC-4645 (Maximo/Magic), AS-01-GA-8318 (Bolero), AS-01-EY-7418 (Bolero), AS-01-HC-2918 (Swift Dzire) which were hired by the Respondent Authorities on different dates during the year 2024 for emergency purposes, including the maintenance of law and order. The said vehicles were subsequently released after being utilized by the Respondent Authorities.
The learned counsel for the Petitioner submitted that, after the release of the vehicles, the Petitioner, on different dates, had submitted bills totaling to Rs. 24,69,214/- before the Respondent Authorities. However, the said amount has not been released to the Petitioner. The learned counsel further submitted that the Petitioner has repeatedly approached the Respondent Authorities for payment of the outstanding dues, but the Respondent Authorities have failed to release the same without any justification. Being aggrieved, the Petitioner has approached this Court under Article 226 of the Constitution of India.
Mr. K. Gogoi, the learned Additional Senior Government Advocate has submitted that though the vehicles mentioned in the writ petition were hired by the Police Commisionerate for maintenance of law and order but while verifying the bills claimed by the Petitioner, it came to light that the Petitioner did not submit upto date RC and insurance along with GST (3B) Form, Driving License, Declaration Certificate. In that regard, he has placed before this Court an instruction dated 18.06.2026 issued by the Deputy Commissioner of Police (Crime), Guwahati, wherein it is also mentioned that the Petitioner was informed to submit the correct documents to the Office for further verification. The said instruction is kept on record and marked with the letter “X”.
Taking into account the above, it is the opinion of this Court that, as it is an admitted fact that the Petitioner's vehicles were taken on hire by the Respondent Authorities, the Petitioner would be entitled to the amounts due upon proper verification of the claims. Such verification shall be carried out upon submission of the Registration Certificates, Insurance, GST (3B) Forms, Driving License and Declaration Certificates.
Mr. N. Ali, the learned counsel appearing on behalf of the Petitioner submitted that the necessary documents would be submitted.
Accordingly, the instant writ petition stands disposed of with the following observations and directions:
The Petitioner shall submit Registration Certificate, Insurance and along with the GST (3B) form, Driving License, Declaration Certificate along with the certified copy of this judgment to the Office of the Director General of Police.
Upon receipt of the said documents along with the certified copy of this judgment, the Respondents shall verify the entitlement of the Petitioner and upon verification, if it is found that the Petitioner is entitled to the amount so claimed or any other amount, the said amount be paid to the Petitioner.
The said exercise be completed within a period of 6 (six) months from the date of submission of the documents as aforesaid along with the certified copy of the instant judgment upon the Respondent No.4 i.e. the Director General of Police, Assam.
