This petition is filed seeking to quash the proceedings in C.C.No. 22656/2001 on the file: of X ACMM, Bangalore. On the basis of the complaint of one R. Narayanamurthy, the police registered a case in Crime No. 425/1999 of Indiranagar Police Station for an offence u/s 420 IPC read with Sections 3, 4, 5 & 6 of Money Circulation Banning Act and commenced investigation. On completion of investigation, charge sheet came 10 be filed against 12 persons as accused. This Court in Crl.P.No. 4007/2002 quashed the proceedings against A4, A7, A9, A10 & All. Further, this Court was pleased to quash the proceedings against A6 in Crl.P.No. 3259/2004 by order dated 10.6.2009. Further, this Court has also quashed the proceedings against A1 & A2 in Crl.P.No. 2729/2009.

Heard Sri K.V. Mahesh, learned Counsel for the Petitioner and Sri Satish R. Girji, learned HCGP for the Respondent/State.

It is submitted by the learned Counsel for the petitioner that to the persons from whom the money has been taken the same has been returned by the Official Liquidator in the Company proceedings in the Chennai High Court. It is also submitted by the learned Counsel for the petitioner that the petitioner also stands on the same footing as those against whom the proceedings are quashed.

Having regard to the fact that the persons placed on par with the petitioner having been exonerated from the case by quashing the proceedings against them, the petitioner also stands on the same footing. Hence, the proceedings as against this petitioner are hereby quashed.
