This appeal is by the claimant seeking for enhancement of compensation as against the award pasted by the Additional MACT and principal Civil Judge (Sr.Dn), Ramanagara In MVC No. 453/2008 on 26.2.2011.

According to the learned counsel for the appellant, though the claimant had sustained fracture of sheft fibuls-proximal third and other injuries i.e., lacerated wound on the frontal region, lacerated wound over the occipital region, lacerated wound on right knew, the Tribunal has awarded only Rs. 15,000/- as compensation on the ground that the claimant has not examined the doctor.

The impugned order is set aside with liberty to the claimant to lead additional evidence. The ratter is remanded to the Tribunal for fresh disposal of the same in accordance with law. Appeal is allowed
The claimant shall appear before the Tribunal on 5.1.2012.
