V.G. Sabhahit, J.—This contempt petition is filed alleging willful disobedience to the direction issued by this Court in W.P. No. 20858/2009 dated 29.03.2011, wherein while quashing Annexure - "K" the respondent was directed to extend all the consequential and monetary benefits as given to the petitioner in the decision in C. Muddaiah''s case.

Notice was issued to the respondent. One Sri. N.B. Dayaberi, S/o Bhimappa, working as Commissioner in Karnataka Housing board has filed the affidavit averring that all the consequential and monetary benefits as given to the petitioner in C. Muddaiah''s case has been granted and cheque has been issued for a sum of Rs. 39,510/- in favour of the complainant.

We have heard the learned counsel appearing for the parties.

Learned counsel appearing for the complainant submits that the entire amount is not paid. The learned counsel appearing for the respondent submits that the order has been complied with.

On going through the affidavit, direction issued and the endorsement given to the petitioner/complainant, we are satisfied that there is compliance of the direction issued by this Court and therefore there is no willful disobedience.

However, if the complainant is aggrieved by the quantum of payment made, it is for him to work out his remedy, in accordance with law.

Accordingly the contempt petition is dismissed. Respondent is discharged.
