By notice dated 28.10.2011, the Petitioner had called upon the Respondent''s consent to appoint an Arbitrator, spelling out therein the disputes that had arisen between them, consequent upon the execution of the Management Development Agreement dated 15.09.2004. In Clause 15 thereof, there is an Arbitration Clause which envisages the appointment of a Sole Arbitrator by mutual consent. In response to the notice dated 28.10.2011, the Respondent has replied evasively and has stated that the matter should be resolved amicably. Despite service, there is no appearance on behalf of the Respondent. In these circumstances, I think it proper to refer the dispute to the Sole Arbitration of Sri N.S. Sangoli, Retired District and Sessions Judge, No. 415/2, ''F'' Block, Sahakaranagar (Next to Hebbal Tank), Bangalore-560092. The Sole Arbitrator shall enter Reference, cause notice to the parties and then proceed to resolve the dispute in accordance with the Arbitration and Conciliation Act, 1996.
Petition stand disposed of accordingly.
Registry to communicate this order to the Sole Arbitrator forthwith. Registry is further directed to return all the original papers, if any, filed along with the Petition to enable the Petitioner to produce the same before the learned Arbitrator.
