Judgment
S. Siri Jagan, J.—The Petitioner applied for participating in the selection process for selection of Munsiff-Magistrate in the Judicial Service, pursuant to the notification issued by the High Court inviting applications. That application was rejected by Ext. P1 for the following defects:
Your photograph in Form-D (Admission Ticket) is not attested by a Gazetted Officer.
Your phonograph in Form-E (Attendance Slip) is not attested by a Gazetted Officer.
Your photograph affixed to your application is not attested by a Gazetted Officer.
The Form-B (Certificate of Character and Conduct) produced by you is not issued by the Gazetted Officer.
The Petitioner challenges the same.
According to the Petitioner, the defects are curable in nature and therefore a lenient view may be taken in the matter.
The learned standing counsel for the High Court points out that without attestation of the photographs in the application form, there is no identification of the Petitioner and therefore that is not a curable defect. He further points out that the rejection of the application on the 4th ground has already been upheld by the Division Bench of this Court in W.A. No. 35 of 2010 during the earlier selection.
I have considered the rival contentions. For the reasons stated by the learned Counsel for the High Court, I do not think that these defects can be condoned because the same are very material in nature. Therefore, the writ petition is dismissed.
