Judgment
This appeal has been filed under section 19 of The Consumer Protection Act, 1986 in challenge to the Order dated 28.01.2020 of the State Commission in complaint no. 536 of 2018.
Learned counsel for the respondent submits on instructions that the respondent will not pursue execution of the impugned Order dated 28.01.2020 of the State Commission. Submission is that the matter may be allowed to abate.
Mr. I.P. Agarwal, power of attorney holder of both respondents, present in person, confirms.
In the wake of the above submissions the appeal appears to have lost its purpose and the same is disposed of with the direction / observation that the respondents shall not pursue execution of the State Commission’s impugned Order dated 28.01.2020 as has been conceded on behalf of the respondents, and the relief provided vide the impugned Order shall be deemed to be unenforceable for all intents and purposes.
The issues involved are kept open. And the decision in this case shall not be treated as a precedent.
The Registry is requested to send a copy each of this Order to the parties in the appeal and to their learned counsel immediately. The stenographer is requested to upload this Order on the website of this Commission immediately.
