Judgment
The writ petition has been specially assigned to the Bench presided by one of us (the Hon’ble Mr. Justice Arindam Sinha).
In the order-sheet we find, by order dated 22nd March, 2018, WP(C) nos.8877 and 15877 of 2016 were tagged. By subsequent order dated 7th March, 2019, WP(C) nos.8063, 8290 and 8871 of 2016 were also tagged. By order dated 11th July, 2018, WP(C) no.8877 of 2016 was delinked. Hence, there are five writ petitions tagged together to be taken up pursuant to the order of special assignment.
Mr. Biswal, learned advocate appears on behalf of petitioner. None appears for petitioner(s) in WP(C) nos.8063 and 8871 of 2016. Ms. Gumansingh, learned advocate appears on behalf of petitioners in WP(C) no.8290 of 2016. Mr. Nanda, learned advocate, Additional Government Advocate appears on behalf of petitioner (State) in WP(C) no.15877 of 2016. Mr. Mishra, learned senior advocate appears on behalf of added opposite party nos.8 to 17 in WP(C) no.7756 of 2016. Mr. Mohanty, learned advocate appears on behalf of applicants in I.A. no.7985 of 2016 and submits, his clients were added as parties to in WP(C) no.7756 of 2016 but consolidated cause title has not been filed by petitioner, as copy not received by him. Mr. Rath, learned advocate appears on behalf of opposite party no.10 in WP(C) no.8290 of 2016. Mr. Sahoo, learned advocate appears on behalf of Orissa Public Service Commission (OPSC). The Commission is opposite party no.1 in WP(C) no.7756 of 2016, opposite party no.3 in WP(C) no.8063 of 2016, opposite party no.3 in WP(C) no.8290 of 2016, opposite party no.1 in WP(C) no.8871 of 2016 and opposite party no.4 in WP(C) no.15877 of 2016. Mr. Udgata, learned advocate appears on behalf of applicant in I.A. no.11135 of 2016 made in WP(C) no.7756 of 2016 and submits, his client’s application was allowed. Copy of the application be served on Mr. Biswal.
We have been told that there are other intervening applicants, whose applications stood allowed but consolidated cause title has not been filed for the amendments to have been carried out. Mr. Biswal submits, the omission, so far as his client’s writ petition WP(C) no.7756 of 2016 is concerned, is because copies of the intervention applications had not been supplied.
Since the five writ petitions have been listed before this Bench after special assignment, the Registry will issue notice on recorded learned advocates for petitioners in WP(C) no.8063 and 8871 of 2016. There is noting in the list that service on proforma opposite parties in the writ petition WP(C) no.8871 of 2016 could not be made due to deficit requisites.
Petitioners in the writ petitions are given liberty to inspect the order-sheets, for ascertaining the intervention applications since allowed and to thereupon file consolidated cause title prior to adjourned date, upon copies circulated to concerned learned advocates for the applicants.
