Under Section 439 of Cr.P.C., the BLAPL has been filed by the petitioners, now in jail custody in connection with PR Case No.42 of 2024-25 corresponding to 2(a) CC Case No.21 of 2024 pending in the court of the learned SDJM, Bhawanipatna for alleged commission of offence under Section 21(b) of NDPS Act.
The Petitioner’s application under Section 439 CrPC has been rejected by the learned District and Sessions Judge-cum-Special Judge, Jharsuguda by order dated 01.05.2024.
It is submitted by the learned counsel for the Petitioner that the Petitioner has no past allegation of similar nature against him and considering the period of incarceration, he is entitled for bail.
Learned Additional Standing Counsel referring to the nature of allegation seeks accommodation to obtain the up-to-date instructions/Case Diary/Criminal Antecedent of the Petitioner for consideration of this Court.
Accordingly, the learned Additional Standing Court shall obtain the up-to-date instructions/Case Diary/past Criminal Antecedent by the next date.
List in the week commencing 18th June, 2024 before the assigned Bench.
