Judgment
Dr. Vineet Kothari, J.—The petitioner, who is an elected Sarpanch of the Gram Panchayat Dhansa, Panchayat Samiti-Jaswantpura, Jalore, has preferred this writ petition assailing the proceedings of Motion of No-confidence dt. 3.7.2013 (Annex-6) of Gram Panchayat Dhansa and prayed for declaring the same to be illegal and allow her to remain on the post of Sarpanch of Gram Panchayat, Dhansa. Prima-facie, against the impugned Resolution dt. 03.07.2012 of Gram Panchayat Dhansa, Tehsil-Jaswantpura, by which a No Confidence Motion against the present petitioner was passed, the petitioner has alternative remedy under Sec. 97 of the Rajasthan Panchayati Raj Act, 1994, which is widely worded revisional power of the State, and the State Government may either on is own motion or on an application from any person interested, may call and examine the record of Panchayat institution and examine the legality or propriety of the same.
In view of availability of alternative remedy being available to the petitioner, the present writ petition is not maintainable and the same is hereby dismissed. No costs. A copy of this order be sent to the concerned parties forthwith.
