Judgment
Heard learned counsel for the petitioner and learned counsel for respondent.
Inspite of two opportunities, the respondent has not filed its reply as yet. However, from the submission it appears that during the pendency of the petition, the respondent has made some payments and it appears that the amount payable as per agreement has been reduced from Rs. 95.57 lakhs approx. to Rs. 30 lakhs approx. On behalf of respondent an indication has been given that this balance amount shall also be paid in a day or two.
In that view of the matter, as prayed on behalf of respondent, last opportunity is granted to file the reply. Let that be done within 10 days. If reply is filed, rejoinder may be filed before the next date. It shall be considered whether it is possible to grant any further interim relief to the petitioner.
In the last order there is an apparent typographical error in indicating the balance then due as Rs. 6.175 lakhs (approx.). That should be read as 61.75 lakhs approx.
Post the matter under the same head on 6.1.22.
